THE GREEN ROOM WINTER PASS – TERMS AND CONDITIONS
1. Overview
The “Green Room Winter Pass” (the “Winter Pass”) provides purchasers (each a “Purchaser”) with access to the “Green Room by TaylorMade” sports simulator experience (the “Sports Simulator”) located at Real Sports Bar & Grill, 15 York Street, Unit A, Toronto, Ontario, M5J 0A3 (“Real Sports B&G”) for a defined number of sessions. The Winter Pass is a time-limited offer made available by Maple Leaf Sports & Entertainment Partnership, d/b/a Real Sports Bar & Grill (“MLSE”), available while quantities last, and is subject to these Terms and Conditions.
2. Redemption Period
The Winter Pass is valid for a four-month period from February 1, 2026 to May 31, 2026 (the “Redemption Period”). The Winter Pass automatically expires when all sessions have been used by the purchaser or at the end of the Redemption Period (whichever is earlier), and does not renew.
3. Winter Pass
There are ten (10) Winter Passes available for purchase while quantities last.The Winter Pass is a package of Sports Simulator sessions. It includes two (2) two-hour Sports Simulator sessions per month during the Redemption Period (i.e., a total of eight (8) two-hour Sports Simulator sessions during the Redemption Period). Customers may contact MLSE at any time to arrange for a different cadence to redeem their sessions.
Any unused sessions for a given month expire at the end of the month and will not be refunded, credited, or carried forward, except where required by applicable consumer protection laws. For more information, Customers are encouraged to contact MLSE.
4. Booking & Availability
All sessions must be booked in advance by the Purchaser online through the designated booking system. Sessions are subject to availability and are not guaranteed for any specific date or time. Blackout dates, peak periods, private events, and operational closures may apply and may limit availability. The Winter Pass does not confer priority booking.
Late attendance to a session may result in the forfeiture of that session and Purchaser shall not be offered a refund, credit, or rescheduling for that missed or late attendance at the session.
MLSE reserves the right to cancel or reschedule sessions booked by the Customer due to operational requirements or events beyond MLSE’s reasonable control, including, without limitation, equipment failure, power outages, severe weather conditions, strikes, war, terrorism, or epidemic. MLSE shall not be liable for any such cancelled or rescheduled bookings.
5. Pricing and Taxes
The Winter Pass costs $499.99 CAD plus applicable taxes. Customers are responsible for the payment of all applicable taxes.
6. Non-Combinability
The Winter Pass cannot be combined with any other offer, promotion, discount, coupon, package, or voucher.
7. Non-Transferability
The Winter Pass is non-transferable and may only be used by its original Purchaser. Resale, transfer, or sharing of the Winter Pass is strictly prohibited.
8. Cancellation and Refunds
The Winter Pass may be cancelled for a full refund within ten (10) days of purchase, provided that no sessions have been used. After the ten (10) day cancellation window, or once a session has been redeemed, the Purchaser may cancel the Winter Pass at any time during the Redemption Period and receive a pro-rated refund based on the number of sessions remaining (excluding any redeemed or expired sessions).
9. No Warranties or Representations, Express or Implied
MLSE makes no warranties or representations, either express or implied, with respect to type, quality, or fitness of the services provided through the Winter Pass or of the Sports Simulator.
10. Equipment
Purchaser shall be responsible for any damage to the Sports Simulator and for any lost, stolen, or damaged equipment provided by MLSE to Purchaser or their guests to use the Sports Simulator, and shall reimburse MLSE for the reasonable costs to repair or replace, at MLSE’s discretion, the Sports Simulator or any other lost, stolen, or damaged equipment.
MLSE shall not be responsible for any lost, stolen, or damaged equipment that Purchaser brings to Real Sports.
11. Health & Conduct
Purchaser and its guests are responsible for ensuring that they are physically capable of using the Sports Simulator.
Purchaser shall, and shall ensure that its guests, comply at all times with the “Sports Simulator Rules and Regulations” and all staff instructions. MLSE reserves the right to refuse service, remove Purchaser or any of their guests, or cancel any booking or the Winter Pass (without refund) if Purchaser or any of their guests engage in conduct that is, in MLSE’s sole discretion, unsafe, disruptive, inappropriate, or otherwise contrary to the “Sports Simulator Rules and Regulations”.
12. Release and Waiver of Liability; Indemnification
The Purchaser and each of their guests must sign and complete the release and waiver of liability provided by MLSE in order to use the Sports Simulator. Any individual who does not sign and complete the release and waiver of liability shall not be allowed to use the Sports Simulator.
The Purchaser acknowledges that using the Sports Simulator involves inherent risks, and voluntarily assumes all such risks, whether known or unknown, arising from or in connection with using the Sports Simulator.
To the fullest extent permitted by applicable law, the Purchaser releases, waives, discharges, and indemnifies MLSE and its affiliates, directors, officers, owners, partners, employees, training and medical personnel, agents, representatives, successors, and assigns (collectively, the “MLSE Parties”) from any and all causes of action, lawsuits, losses, damages, injuries (including death), claims, demands, sums, costs, expenses (including legal fees and disbursements), and any other liability of any kind, of or to Purchaser or any of their guests, arising out of or in connection with the Winter Pass or the Sports Simulator.
13. Limitation of Liability
In no event shall the MLSE Parties be liable for any direct, indirect, special, exemplary, punitive, incidental, or consequential damages of any kind, whether based in contract, tort, or otherwise, which arise out of or in connection with these Terms and Conditions, the Winter Pass, or the Sports Simulator. To the extent permitted by applicable law, MLSE’s total liability, if any, shall not exceed the amount paid by the Purchaser for the Winter Pass.
14. Acceptance
Purchase and use of the Winter Pass constitutes acknowledgement that the Purchaser has read, understood, and agreed to these Terms and Conditions.
15. Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada. Any dispute arising out of or in connection with these Terms and Conditions, the Winter Pass, or the Sports Simulator shall be subject to the exclusive jurisdiction of the courts located in the City of Toronto, Ontario.
16. General
(a) The Winter Pass does not provide, make, or guarantee a reservation at Real Sports B&G.
(b) The Winter Pass does not include food, beverage, gratuities, or any other incidental or personal expenses.
(c) These Terms and Conditions, together with any other legal instruments, documents, and rules and regulations referenced herein, constitute the entire agreement between MLSE and Customer relating to the Winter Pass and supersede any prior understandings or agreements (whether written or oral), and may not be amended except in writing.
(d) If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
(e) MLSE reserves the right to modify these Terms and Conditions or any other terms and conditions related to the Winter Pass, use of the Sports Simulator, or access to Real Sports B&G.
(f) MLSE’s failure to enforce any of these Terms and Conditions shall not constitute a waiver or that, or any other, provision.
(g) All interpretations of these Terms and Conditions are at MLSE’s discretion, and MLSE’s decisions will be final.
